Laboucan to get new trial

A Fort St. John man found guilty of taking part in the gruesome killing of a 13-year-old girl in the Edmonton area more than three years ago has successfully appealed his murder conviction.
The Alberta Court of Appeal has ordered a new trial for 23 year old, Joseph Laboucan, who was convicted of first-degree murder, kidnapping and aggravated sexual assault in the April 2005 killing.
Two of three appeal judges decided the trial judge made an error, in assessing Laboucan’s credibility as a witness.
At his 2007 murder trial, witnesses testified he was the ringleader in a plan to lure the girl from the West Edmonton Mall on the promise of taking her to a party.
Instead, she was taken to the Springs Resort Golf Course west of Edmonton, where she was viciously raped and killed.
When Laboucan took the stand in his own defence, he testified he was unaware the party was a ruse, and went into shock when the girl was attacked by a group of teens.
However, he’s still being held in custody on unrelated criminal charges.
Last September, Laboucan was also charged with second-degree murder in the death of an Edmonton prostitute.
