Metcalfe also did not face charges after he passed out at the wheel of his vehicle last fall and struck a jogger, killing him. That accident led to a diagnosis of cancer, and he has recently been completing rounds of chemotherapy.

Joel Christopher Marchand is also charged with manslaughter in Chris Ball's death, along with assault causing bodily harm, and has elected to a trial by judge and jury. A date for his trial will soon be set.
Ball suffered extreme brain damage when he was beaten on the corner of 100th and 100th at 2:43 a.m. on July 22, 2012. He later died when he was taken off life support on August 2.
